California Proposition 65 Letter

Re: Proposition 65 - Compliance Notification to OMIX-ADA, Rugged Ridge and Alloy Customers

Dear OMIX-ADA, Rugged Ridge and Alloy Customer.

As you likely know by now, the State of California mandates that consumers receive a “clear and reasonable warning” prior to the sale of a product that contains one or more chemicals “known to the State to cause cancer or reproductive toxicity.” More information about this law can be found at Cal. Code Reg., tit. 27, § 25600.2, which is commonly referred to as Proposition 65 (“Prop 65”).

OMIX-ADA, Rugged Ridge and Alloy have determined that its products may result in exposure to one or more Prop 65 listed chemicals. Attached on Exhibit A is a list of OMIX-ADA, Rugged Ridge and Alloy products, all of which require a warning to consumers. The applicable warning for our products is as shown below:



ATTENTION STATE OF CALIFORNIA CONSUMERS

All products listed on Exhibit A or otherwise manufactured by OMIX-ADA, Rugged Ridge and Alloy will include the applicable warning language on their packaging, and warnings will also be published in any related brochures available for distribution to consumers.

Please note the additional items for which you are responsible:

1) Physical retail sites in the State of California. If you have or sell to retail operations physically located in the State of California, please contact your sales representative to obtain sticker or tags for your or your retailers’ Point of Purchase displays in California. You or your retailers are required to place this sticker and/or tag on all Point of Purchase displays for OMIX-ADA, Rugged Ridge and Alloy products located in the State of California. The sticker and/or tag cannot be modified and it must be prominently displayed on (or, if a tag, near) the header card or in another location where a consumer is likely to read and understand the notice. To ensure timely compliance, you or your retailers are required to place these stickers and/or tags on displays no later than August 30, 2018.

2) Internet sales to California consumers. Whether or not you or your retailers sell product in a physical retail location in the State of California, you and your retailers are also now responsible for the placement and maintenance of the applicable warning language for any OMIX-ADA, Rugged Ridge and Alloy products that you or your retailers sells over the internet to California consumers. Finally, please note that this letter does not replace or supersede any terms and conditions you have in place with OMIXADA, Rugged Ridge and Alloy. You continue to be subject to all obligations under those terms.
